Navigating custody arrangements can feel overwhelming—especially when you're trying to protect what matters most. Whether you’re preparing for divorce or adjusting an existing order, we provide clear legal guidance rooted in experience and care.

In Texas, custody is legally referred to as conservatorship, which determines each parent’s rights and duties regarding their child. Most parents are named joint managing conservators, meaning they share decision-making responsibilities. In some cases, one parent may be appointed sole managing conservator if it serves the child’s best interests.

In addition to conservatorship, the court also addresses possession and access—which outlines the visitation schedule and how time is shared between parents. Texas often starts with a Standard Possession Order, but modifications can be made based on your family’s needs, distance, and your child’s best interest.

Texas courts prioritize the well-being of the child, and so do we. Together, we’ll build a plan that supports your family—whether through a cooperative parenting agreement or courtroom advocacy when needed.

How custody is decided in Texas

How Texas Courts Decide Custody

The legal process for determining custody depends on your family’s unique situation. If custody is part of a divorce, the path may differ based on whether the case is contested or uncontested. When parents are not married, a Suit Affecting the Parent-Child Relationship (SAPCR) is typically required to establish custody, visitation, and support rights.

Regardless of the circumstance, the court’s primary focus is always the best interest of the child. That includes evaluating each parent’s ability to provide a stable, supportive environment.

We help clients gather essential documents — such as school records, financial disclosures, and medical history — to support their case. We’ll also work together to create a parenting plan that encourages cooperation and reduces future conflict whenever possible. We can help with:

Understanding Standard Possession Schedules in Texas

What Is Standard Possession in Texas?

Texas law outlines a Standard Possession Order (SPO) that serves as the default visitation schedule in many custody cases. It’s designed to provide structure while allowing flexibility for families based on their unique circumstances.

For parents living within 100 miles of each other, the SPO generally includes:

  • Thursday evenings during the school year
  • The 1st, 3rd, and 5th weekends of each month
  • Alternating holidays
  • Up to 30 days of summer visitation

When parents live more than 100 miles apart, the schedule may shift to include:

  • One weekend per month (optional)
  • Extended summer visitation (up to 42 days)
  • Spring break visitation
  • No midweek visits

If safety concerns exist, the court can require supervised visitation, either through a neutral third party or an agreed-upon family member. we’ll work with you to ensure that your child’s safety and best interests remain the top priority—whether that means advocating for modifications or helping you understand your rights under the law.
